How to get your money back when you are scammed into transferring money through your account
Currently, to recover money fraudulently transferred to banks, victims need to apply legal options appropriate to each specific case. Some common ways used to recover scammed funds are:
– Notify the bank immediately after discovering the wrong transfer of money to another person’s account. In this case, the bank will temporarily block the money just deposited into the scammed person’s account to conduct verification and check if there are any signs of confusion or errors.
According to the provisions of Clause 4, Article 36 of Circular 23/2010/TT-NHNN, when the payment order has the wrong address, name, and account number of the recipient (correct name but wrong number and vice versa… ), the bank will temporarily block and lock the account to fix the above errors. This gives the scammed person more time to resolve the problem, and the scammer cannot appropriate the victim’s money during this time.
In case the beneficiary’s account is locked or frozen but the money you transferred is still in the account, the bank will refund the money to the victim who was mistakenly transferred. However, if the wrong amount has been withdrawn, the bank will notify the account holder and ask them to return the money to you. If they do not pay, the victim can rely on this to sue in court or report to the police to reclaim the defrauded money.
– After notifying the Bank to prevent unauthorized withdrawals and being unsuccessful in receiving back the fraudulent amount due to the money transfer order having no errors, the victim needs to file a report with a public agency. an. If you know information about the scammer’s address or residence, the victim should file a report at the police station at that address. In case the scammer or the scammer’s residential address is unknown, the victim needs to report it to the police station where he or she resides. Reporting to the police is a necessary action to help you find the person who committed bank fraud. Only when you know the identity and address of the fraudster can you request a refund of your lost property.
In addition, reporting also provides a basis for the police to detect and prosecute criminals for criminal liability. In case a person is discovered and identified as having committed a fraudulent act, even if it is not enough to be prosecuted for criminal liability, the investigation agency’s written conclusion identifies the person’s violation, along with information. Information about the scammer’s residence address is the basis for the victim to sue this person to reclaim the defrauded property.
