Currently, the base salary on July 1, 2023 is 1.8 million VND/month. Therefore, the one-time allowance when giving birth is: 1.8 million VND x 2 = 3.6 million VND.
In case of giving birth but only the father participates in social insurance, the father will receive a one-time allowance equal to 2 times the base salary in the month of birth for each child.
Maternity benefits
– For female workers giving birth:
According to Article 39 of the Law on Social Insurance 2014:
Benefit level = 100% x Average monthly salary paid for social insurance 6 months before leaving x 6 months
In case the full 06 months have not been paid, the benefit level is calculated based on the average monthly salary of the months paid.
– Subsidies in other cases:
Benefit level = Average monthly salary paid for social insurance 6 months before leaving: 24 x Number of days off.
Will maternity benefits for female employees change from July 1, 2024?
On November 10, 2023, the National Assembly passed a Resolution on the state budget estimate for 2024. The Resolution clearly stated that, from July 1, 2024, comprehensive reform of salary policy according to Decree No. Resolution 27-NQ/TW of 2018 of the Seventh Conference of the 12th Central Executive Committee.
Specifically, in Clause 1, Article 3 of Resolution 104/2023/QH15, from July 1, 2024, officials, civil servants and public employees will have a comprehensive reform of salary policy. From this date, the base salary will be abolished and instead new basic salary tables will be established in specific amounts.
Thus, when reforming wages from July 1, 2024, the 2024 maternity benefit level for female employees will also change.
Accordingly, from January 1, 2024 to June 30, 2024, some maternity benefits calculated based on the base salary for female employees are still calculated at the base salary of 1.8 million VND.
In addition, Article 63 and Article 64 of the Draft Law on Social Insurance stipulates the level of maternity benefits as follows:
– The monthly benefit level is equal to 100% of the average salary as a basis for social insurance payment of 06 months before taking leave to enjoy maternity benefits.
– In case the employee has paid social insurance for less than 6 months, the level of maternity benefits is as prescribed in Article 56, Article 57, Clauses 2, 4, 5, 6, Article 58, Article 59, Article 60 and Article 62 of the Law on Social Insurance is the average salary as the basis for social insurance payment of the months paid.
– The level of benefits for convalescence and health recovery after maternity is also specifically regulated at 540,000 VND per day.
– The one-time allowance when giving birth or adopting a child for each child specified in Clauses 1, 2 and 3, Article 63 of the Draft Law on Social Insurance is equal to 3,600,000 VND (no longer depends on the base salary). ).
However, currently, there is still no official document providing specific regulations and instructions on maternity benefits when implementing salary reform from July 1, 2024.
Thus, in case the base salary is abolished from July 1, 2024 when reforming the salary, the level of maternity benefits related to the base salary may change accordingly.
